Snag?

The arrogance of the elite:
SAN ANGELO, Texas (AP) - Parents' hopes of quick reunions with more than 400 children removed from a polygamist sect's ranch were dashed Friday after their attorneys and a judge clashed over proposed restrictions.
A decision by Texas District Judge Barbara Walther means that to regain custody, the 38 mothers whose filed the complaint that led the Texas Supreme Court to reject the state's massive seizure must personally sign an agreement their attorneys and state child-welfare officials have proposed.
This is the same female judge that authorized this state kidnapping disaster in the first place.
Her farcical, arrogant, chaotic performance on April 17-18, 2008 utterly failed to deliver basic due process to parents whom she personally threatened with a penalty worse than death: the taking of their children.
State and federal law required this clown of a judge to hold a “full adversarial hearing” before removing any one of these children from the care and custody of their parent.

Looks a bit out-of-sorts, doesn't she? Well, no wonder, a decision of HERS has been challenged and overturned. How dare we do such a thing!

A “full adversarial hearing” is not in the statute by chance or by Texas choice. It is a fundamental element of due process under the 14th Amendment of the Constitution of the United States. Even if the Texas legislature didn’t want it there, it would be required of Texas as a prophylactic against invasion by the U.S. military. The right to due process is that fundamental to our way of life in the United States.
Judge Walther has admitted ignoring the law with her decision to not conduct a “full adversarial hearing” for each and every parent accused in this matter and allowing the Texas CPS to gallop off half-cocked and totally stupid in their zeal to abduct the children, none of which had broken any law or violated any statute, and none of whom has been shown(then or now) to have been "abused" in any way.

The Texas Supreme Court has ordered the return of these children to their parents and this screwball judge has no business whatever trying to attach "conditions" to their return. That is nothing more than another demonstration of this woman's arrogance and disrespect.

This out-of-control judge should be forced from the bench and prosecuted(for numerous civil rights violations just for starters), and this case needs to be handed over to someone a lot saner... and a lot more lawful.

We have way too many judges across the nation creating their own version of the law. This woman is a classic example. At least in this case, this judge has been caught and exposed. Now she needs to be made an example of, so other judges... who believe themselves to be the ultimate lawmakers of the land... will take heed.

I have the bad feeling that the State of Texas is going to lose a LOT of money in the upcoming lawsuits. "Judge" Walther should be required to pay all losses... She's responsible for this whole disaster.
